These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Babify ("Company," "we," "us," or "our") concerning your access to and use of the babify.art website and AI image generation service (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws and regulations
• All information you provide is accurate, current, and complete

3. Account Registration

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion.

4. Service Description

Babify provides an AI-powered image generation service that creates baby-themed images based on user prompts and reference images. The Service includes:

• Text-to-image generation using AI models
• Reference image upload and processing
• Multiple resolution options (2K, 4K)
• Prompt enhancement features
• Image storage and management
• Credit-based usage system

5. Credits and Pricing

5.1 Credit System

Our Service operates on a credit-based system where:

• 1 credit = 1 generated image
• New users receive 1 free credit upon registration
• Credits are purchased through one-time payments
• Credits do not expire
• Credits are non-refundable except as required by law

5.2 Pricing Plans

Current pricing plans:

• Starter Pack: $9.90 for 50 credits
• Family Pack: $19.90 for 150 credits
• Premium Pack: $49.90 for 500 credits

We reserve the right to modify pricing at any time. Price changes will not affect credits already purchased.

5.3 Payment Processing

Payments are processed securely through our third-party payment processor (Creem). By making a purchase, you agree to the payment processor's terms and conditions. We do not store your payment card information.

6. Refund Policy

Due to the digital nature of our Service:

• All credit purchases are final and non-refundable
• Unused credits remain in your account indefinitely
• We do not provide refunds for generated images
• Refunds may be issued at our sole discretion in cases of technical errors or service failures

If you believe you are entitled to a refund, please contact support@babify.art within 7 days of purchase.

7. User Content and Conduct

7.1 User Content

You retain ownership of the content you provide (prompts, reference images). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store your content solely for the purpose of providing the Service.

7.2 Prohibited Content

You agree not to upload, generate, or share content that:

• Is illegal, harmful, threatening, abusive, or offensive
• Infringes on intellectual property rights
• Contains nudity, sexual content, or exploitation of minors
• Promotes violence, discrimination, or hatred
• Contains malware, viruses, or harmful code
• Violates any applicable laws or regulations
• Impersonates any person or entity

7.3 Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use automated systems (bots, scrapers) without permission
• Reverse engineer or attempt to extract source code
• Resell or redistribute the Service
• Share your account credentials with others

8. Intellectual Property Rights

8.1 Generated Images

You own the generated images created through the Service. You may use these images for:

• Personal use
• Social media sharing
• Printing and physical products
• Commercial use (Premium Pack users only)

8.2 Service Content

The Service, including its design, features, code, and branding, is owned by Babify and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES. WE DO NOT GUARANTEE SPECIFIC RESULTS OR AVAILABILITY. OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE PAST 12 MONTHS.
